SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.
_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

In these User Generated Content (UGC) Terms of Use, "we," "us" and "our" refers to Seek More Wilderness, LLC.

The "Photo" refers to the photo(s), caption and comments you posted on Facebook, Twitter, Instagram or Pinterest ("Social Media") described in the message we sent referring you to these UGC Terms of Use.

By responsing to our message with "#YESWILDERNESS," you agree that we may use your Photo in accordance with these UGC Terms of Use:

ABOUT YOU
You represent and warrant that:
-You are at least eighteen (18) years of age or are legally considered an adult int he State or Country where you reside;
-You have full power and authority to agree to these UGC Terms of Use;
-The Photo is your own original creation, you did not take the photo from another website, social media posting or elsewhere, and the Photo does not contain anything that violates the rights of any person or entity;
-The Photo does not contain any trademarks, logos, brand names, advertising, sponsorship, or promotional material owned by any person or entity, other than you or Seek More Wilderness, LLC;
-The Photo does not contain anything illegal, defamatory, obscene or offensive;
-You have permission from any person(s) appearing in the Photo to provide us with the rights to use the Photo as described in these UGC Terms of Use;
-Your upload or post of the Photo does not violate any applicable laws or the terms or requirements of the Social Media platform(s) where you uploaded or posted the Photo;
-Our use of your Photo as described in these UGC Terms of Use will not violate the rights of any person or entity and will not violate any law.
-You confirm and agree that Our use of your Photo as described in these UGC Terms of Use does not and shall not require any payment to any person or entity and does not require license, authorization, approval or consent by any other person or entity; and
-You have read and you agree to comply with all of the terms and conditions in these UGC Terms of Use.

OUR USE OF YOUR PHOTOS
You grant us the right to share your Photo without payment of any royalty. We may use your Photo on our website, social media pages, and our digital newsletters. You grant us the right to use your username, real name, caption, location, and other identifying information in connection with the use of the Photo.

You confirm that you have the consent or permission of any other person or entity that is required for our use of your Photo as described in these UGC Terms of Use, including but not limited to: (a) any person who appear or performs in your Photo, and (b) any person or entity who owns any rights in your Photo or anything that appears in your Photo. 

COPYRIGHT POLICY
We respect the intellectual property of others, and we ask you to do the same. If you believe that your Photo has been copied in a way that constitutes copyright infringement, you may provide us with written notification of your claim in accordance with the requirements of the U.S. Digital Millennium Copyright Act of 1998 and instructions in the site Terms of Use at www.seekmorewilderness.com or in the site Terms of Use applicable in your country as available on our local website.

LIMITATION OF LIABILITY
You shall be liable for and shall indemnify us against any and all claims, actions, liabilities, losses, damages, expenses (including reasonable legal expenses) incurred by us which arise directly or indirectly from a breach by you of your obligations, representations or warranties under these UGC Terms of Use.

MISCELLANEOUS
These UGC Terms of Use are personal to you and may not be assigned or transferred by you for any reason whatsoever without our prior written consent. We may assign our rights and obligations under these UGC Terms of Use to any other person, in whole or in part, without consent.

A failure by us to exercise and any delay, forbearance or indulgence by us in exercising any right, power or remedy under these UGC Terms of Use (in whole or in part) shall not operate as a waiver of that right, power or remedy or preclude its exercise at any subsequent time or on any subsequent occasion. A person not a party to these UGC Terms of Use has no right to enforce any of these terms.

These UGC Terms of Use contain all the terms agreed between us regarding the Photo and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

The construction, validity and performance of these terms shall be governed by the laws of the State of Minnesota, USA and the parties submit to the exclusive jurisdiction of the courts of Minnesota to resolve any dispute arising under or in connection with these UGC Terms of Use. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these UGC Terms of Use are invalid, then that provision will be removed without affecting the rest of the UGC Terms of Use. The remaining provisions of these UGC Terms of Use will continue to be valid and enforceable.
